All use of www.MuniPOINTS.com is by governed by the MuniPOINTS Online Services AGREEMENT. If your employer is not party to a MuniPOINTS Online Services AGREEMENT currently in force, then you are not authorized to use this site. Your registering on and/or logging into this site using a valid user ID and password signifies that (a) your employer is party to a MuniPOINTS Online Services AGREEMENT currently in force, and (b) you agree with the terms and conditions of use set forth therein.

In addition to other important terms and conditions set forth in your employer’s MuniPOINTS Online Services AGREEMENT, the following general terms apply to your use of this site:
  1. DPC DATA will own, at all times, all right, title and interest in, or appropriate licenses to, any and all data, patents, trademarks, trade secrets, trade names, copyrights, methods, know-how and all other intellectual property rights of DPC DATA (collectively, “Intellectual Property”). Without limiting the foregoing, DPC DATA’s Intellectual Property hereunder includes content comprising MuniPOINTS.

  2. Licensee is not authorized to provide or otherwise disclose the parameters, code, authentication procedures or any portion of MuniPOINTS to any third party, use MuniPOINTS to act as a service bureau for municipal bond data content, or enter into a timesharing arrangement that gives any third party access to MuniPOINTS.

  3. Licensee shall not create any works derived from MuniPOINTS or integrate MuniPOINTS into any work, except for the internal use of Licensee.

  4. Licensee shall not make any part of MuniPOINTS available on any web site or other medium accessible to persons other than Licensee’s employees who are expressly authorized to use MuniPOINTS.

  5. Under no circumstance may Licensee display or otherwise disclose any code, parameters, or authentication procedures pertaining to MuniPOINTS other than as expressly authorized by the MuniPOINTS Online Services AGREEMENT.

DPC DATA shall use reasonable efforts to ensure that content delivered to Licensee through MuniPOINTS is valid and accurate; however, all content delivered to Licensee through MuniPOINTS is provided "AS IS" and, without limiting the generality of the foregoing, DPC DATA makes no warranties with respect to the accuracy or completeness of the MuniPOINTS content or other content provided through MuniPOINTS. DPC DATA shall not be liable to Licensee for any loss, injury, claim, liability or damage of any kind resulting in any way from (a) any errors in or omissions from MuniPOINTS content or any materials included therein, (b) the unavailability or non-delivery of MuniPOINTS content or any features thereof or any materials included therein, or (c) Licensee's use of MuniPOINTS.

Except as expressly provided in this Agreement, DPC DATA makes no warranty with regard to the content, accuracy or completeness of the information contained within MuniPOINTS. EXCEPT AS EXPRESSLY PROVIDED IN THIS AGREEMENT, NEITHER DPC DATA NOR ITS SUPPLIERS OR LICENSORS SHALL BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH THE DATA FEED AND THIS AGREEMENT, EVEN IF DPC DATA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. DPC DATA'S TOTAL LIABILITY UNDER THIS AGREEMENT OR IN CONNECTION WITH ANY OTHER CLAIM ARISING OUT OF OR RELATING TO MuniPOINTS SHALL NOT EXCEED THE AMOUNT PAID TO DPC DATA BY LICENSEE FOR THE CURRENT ANNUAL TERM OR ANY RENWAL TERM OF THIS AGREEMENT.

Your use of this site is exclusively pursuant to the MuniPOINTS Online Services AGREEMENT, and performance hereunder shall be governed and construed in accordance with the laws of the State of New Jersey. Licensee and DPC DATA have submitted to the exclusive jurisdiction of any state or federal court sitting in the State of New Jersey in any action or proceeding arising out of or relating to this Agreement.
